Welcome to the ♪ Mylo ♫ universe, where AI transforms your imagination into musical reality. These Terms of Use govern your access to and use of the Mylo application and services. By accessing or using Mylo, you agree to be bound by these Terms.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and Mylo regarding your use of the Mylo application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 13 years of age.
• You have the right, authority, and capacity to agree to these Terms and to abide by them.
• Your use of the Service does not violate any applicable law or regulation.

3. Account Registration

To access certain features of the Service, you may need to create an account. When registering for an account, you agree to:

4. AI-Generated Music and Content

Mylo uses artificial intelligence to generate music based on your inputs and preferences. Regarding AI-generated content:

• Ownership: You own the music you generate using Mylo, subject to the license granted to us below.
• License to Mylo: You grant Mylo a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display the music you generate for the purposes of operating, improving, and promoting the Service.
• Third-Party Rights: You are responsible for ensuring that your use of the generated music does not infringe on any third-party rights.
• Commercial Use: You may use the music you generate for personal or commercial purposes, subject to the limitations in these Terms.

5. Prohibited Uses

You agree not to use the Service to:

• Violate any law, regulation, or these Terms.
• Infringe on the intellectual property rights of others.
• Generate or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service for any commercial purpose without our express written consent.
• Engage in any activity that could disable, overburden, or impair the Service.
• Use automated scripts to collect information from or interact with the Service.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Mylo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works based on the Service.
• Distribute, publicly display, publicly perform, or publicly digitally perform the Service.
• Reverse engineer, decompile, or disassemble the Service.
• Remove any copyright or other proprietary notices from the Service.

7. Subscription and Payments

Mylo may offer subscription-based access to premium features. For subscription services:

• Billing: You agree to pay all fees and charges associated with your account on a timely basis and according to the fees schedule and terms displayed to you at the time of purchase.
• Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You can cancel your subscription through your App Store account settings.
• Price Changes: We reserve the right to adjust pricing for our Service or any components thereof in any manner and at any time as we may determine in our sole discretion.
• Refunds: Payments are non-refundable except as required by law or at our discretion.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• That the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
• That the results that may be obtained from the use of the Service will be accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Mylo, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless Mylo, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your content caused damage to a third party.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mylo is established, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within this jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
